Legal Experts Call The Crowd in Maumere Spontaneous, There Is No Criminal Element

JAKARTA - Professor of Law Studies at the University of Al Azhar Indonesia Prof. Agus Surono said that the crowd in Maumere East Nusa Tenggara (NTT) that occurred when President Joko Widodo (Jokowi) passed was something spontaneous. Therefore, he considered that the incident did not have a criminal element

 In his written statement, the Professor of Law at the University of Al Azhar Indonesia said that the cause of the crowd must be distinguished.

 "At the President's visit this time the community came spontaneously and there was no formal or special invitation, and the President still urged people to adhere to health protocols and use masks," said Agus in a written statement, Tuesday (2/3/21).

 Agus saw that the people who attended were a form of enthusiasm to see and communicate with President Jokowi.

 Moreover, the President's visit to the region brought positive changes.

 "I think this is part of the enthusiasm of the people who want to see and communicate directly with their leaders and it rarely happens," said Prof. Agus Surono.

 That is according to Prof. Agus Surono that must be responded positively, because the presence of the President is to bring change in the area.

 He also compared the crowd in Maumere with the crowd in Petamburan, Central Jakarta.

 In the crowd at Petamburan, he saw that there was an intentional invitation that led to an act against the law.

 "It is different from the incident that occurred in petamburan which was preceded by the element of a special invitation and invitation," said Prof. Agus.

 The Professor of Law added that the petamburan incident had a cause and this must be distinguished and the legal consequences were different.

 "So the incident in Maumere cannot qualify as a criminal event," said Prof. Agus.

 He further said that at the time of the crowd in Petamburan, DKI Jakarta Province was imposing Large-Scale Social Restrictions (PSBB).

 This means that there is an element of lawlessness in accordance with the provisions of the Health Quarantine Law, especially Article 93.

 "Article 93 is clearly not allowed to have crowds and obstruct certain actions to maintain the quarantine properly, because in the situation in Petamburan DKI Jakarta is still PSBB," said Prof. Agus.

 Regarding the steps taken by the National Police Criminal Investigation Unit in rejecting public reports about the crowd in Maumere, he saw this as something true.

 This is because there was no criminal element in the Maumere incident.

 "The police have the subjective right to proceed further or not. If there is no criminal act, there is no need for an investigation process," explained Prof. Agus.

 This Professor of Law explained that if the report contains a criminal incident, then the investigation process will be carried out.
 That, too, could have been stopped later if there was not enough evidence.

 "What happened to Maumere was not a criminal incident because there was no mistake in an appeal and against the law," said Prof. Agus.

 On this occasion, he also appealed to the public to see an event in its entirety and in accordance with the facts.

 If indeed the information received does not match the facts, then he asks the public not to share it on social media.

 "We must be smart in filtering information based on facts. If it is not based on facts, don't add it. Facts cannot change, cannot be added or subtracted," said Prof. Agus.

 Currently, continued Prof. Agus, there are many things that are far more important to complete, one of which is the vaccination program so that Indonesia can be free from the COVID-19 virus.

 "We still have a lot of homework in the future, especially during the pandemic. We must encourage the government so that vaccines can be resolved immediately for all levels of society. This is more important for Indonesia to be more advanced," concluded Prof. Agus.
